OCI for minors

OCI card for a minor or newborn born in the USA

A child born in the USA to Indian parents is a US citizen by birth — and eligible for an OCI (Overseas Citizen of India) card in their own name, because a parent (or grandparent) is or was an Indian citizen. The OCI application for a minor born in the USA is one of the most common applications there is, and also one of the easiest to get wrong: it needs more documents than an adult application, from both parents. This guide covers the whole process, including the newborn case.

Who is eligible

Any minor whose parent, grandparent, or great-grandparent is or was an Indian citizen can apply, including a newborn — there is no minimum age. The child needs their own US passport first; the OCI application references it. If a parent is still an Indian citizen, that parent's passport is the proof of Indian origin; if both parents have naturalized, their surrender certificates and old Indian passports serve the same purpose.

OCI checklist for minors born in the USA

The full breakdown, including what changes for divorced or single parents, is in the OCI documents checklist. Divorced parents add the custody order; joint custody also needs a notarized consent letter from both parents. A single parent signs a statement explaining why there is no marriage certificate.

The steps, in order

1. Get the child's US passport. 2. Order the birth certificate and start the state apostille — this is the long pole, often one to three weeks. 3. Prepare the photo and thumb impression to spec. 4. Fill the government application online (Part A and Part B) and upload the documents. 5. Complete the VFS application and pay the fees. 6. Mail the packet with the notarized parental authorization. 7. Track the application until the card comes back.

Fees and processing time for a minor's OCI

The government fee for a minor's new OCI card in the USA is $100, plus the $3 ICWF fee and the VFS service fee. Processing typically takes about 4 to 8 weeks once VFS receives a complete packet — incomplete packets, usually a missing apostille or an unsigned authorization, are what stretch it longer. See OCI fees and processing time for the full picture.

Common questions

How young can a baby be to get an OCI card?

There is no minimum age. A newborn can apply as soon as they have a US passport and an apostilled birth certificate.

Does a minor's birth certificate need an apostille for OCI?

Yes. A US-issued birth certificate must be apostilled by the state where the child was born before the consulate accepts it.

How much is the OCI fee for a minor in the USA?

A $100 government fee, plus the $3 ICWF fee and the VFS service fee — the same structure as the adult application, at the minor rate.
